Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Hitou website, applications, and related services (collectively, the "Service") operated at hitou.gg ("Hitou", "we", "us", or "our").

By creating an account, accessing the Service, or completing a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

These Terms are written and binding in English. Any translation is provided for convenience only. If there is a conflict between an English version and a translation, the English version controls.

2. Eligibility

You must be at least 18 years old (or the age of majority in your place of residence, if higher) and legally able to enter a binding contract. You may not use the Service if doing so would violate applicable law in your jurisdiction.

You are responsible for ensuring that your use of chance-based pack products, digital wallet balances, and physical card redemptions is lawful where you live.

3. Accounts

You must provide accurate registration information and keep your login credentials secure. You are responsible for all activity under your account. Notify us promptly at hello@hitou.gg if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, create risk for other users or the Service, or appear fraudulent or abusive.

4. The Service

Hitou provides, among other things:

• Pack openings (including paid opens and free demo opens where available)
• A digital vault for cards and related inventory
• Wallet balances for purchases and certain payouts
• Optional redemption / shipping of physical cards, subject to fees, availability, and verification
• Marketplace, consignment, or related features when enabled on the Service

Features may change, be limited by region, or be disabled for maintenance, compliance, inventory, or product reasons.

5. Packs, Odds, and Chance-Based Products

Pack openings involve chance. You acknowledge that outcomes are uncertain, that you may receive lower-value items than the amount you spent, and that past results do not predict future results.

Published drop rates, value ranges, buyback rates, and similar disclosures are informational descriptions of the configured pack mechanics at the time shown. We may update pack contents, rates, and pricing. Demo opens are for entertainment / preview only and do not grant ownership of physical or vaulted cards unless we expressly say otherwise.

Hitou is not a casino, lottery operator, or investment product. Pack purchases are for collectible entertainment. You should only spend money you can afford to lose.

6. Wallet, Payments, and Fees

Deposits, withdrawals, and payments may be processed by third parties (for example card processors or blockchain networks). You agree to their applicable terms. Network fees, processor fees, FX conversion, and Hitou platform fees may apply and will be disclosed where practicable before you confirm a transaction.

Wallet balances are denominated as shown in the Service (currently USD cents for accounting). Balances are not bank deposits, are not insured, and may be subject to holds, reviews, or limits for fraud, compliance, or risk management.

Crypto transfers are irreversible once broadcast. You are solely responsible for sending supported assets on supported networks to the correct deposit address. Unsupported assets or wrong networks may be unrecoverable.

7. Vault, Title, and Redemption

When you obtain a card through a paid open or other qualifying transaction, your account reflects vaulted inventory subject to these Terms. Physical possession remains with Hitou (or our fulfillment partners) until a redemption is completed and shipped.

Redemption, shipping, buyback, and related options may require fees, identity or address verification, and inventory availability. We may refuse or delay redemption where required for fraud prevention, sanctions compliance, or legal reasons.

8. Prohibited Conduct

You agree not to:

• Violate any law or third-party right
• Use bots, scrapers, exploits, or automated systems to manipulate odds, inventory, pricing, or accounts
• Circumvent geoblocks, sanctions controls, payment controls, or security measures (when such controls are enabled)
• Engage in money laundering, fraud, or chargeback abuse
• Harass users or staff, or upload unlawful, infringing, or harmful content
• Reverse engineer the Service except to the limited extent allowed by mandatory law

9. Intellectual Property

The Service, including branding, software, UI, and original content, is owned by Hitou or its licensors. Trading-card artwork, names, and trademarks remain the property of their respective owners. Hitou is not affiliated with or endorsed by The Pokémon Company, Nintendo, Creatures, Game Freak, PSA, or other rights holders unless expressly stated.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that inventory, grading data, market prices, or third-party services will be accurate or available.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HITOU AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO HITOU FOR THE TRANSACTION GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS BEFORE THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted.

12. Indemnity

You will defend and indemnify Hitou against claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms.

13. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after an update constitutes acceptance of the revised Terms, except where mandatory law requires a different process.
